Why is a notice to vacate important in rental contracts?

Everyone wants to avoid the headache of a tenancy termination, right? That's exactly what an eviction notice does. But what exactly is it and why is it so important?

A notice to vacate is a unilateral declaration by the tenant agreeing to leave the property when the tenancy ends. The advantage of this is that if the tenant does not want to move out, the declaration allows the landlord to seek enforcement directly, without having to engage in lengthy litigation.

Any notary can prepare this declaration, so the tenant can conveniently choose the nearest office.

It is important to note that, in addition to the above declaration, the landlord can also ask the tenant for a unilateral declaration of commitment, which allows the landlord to claim directly by way of enforcement for payments arising from the tenancy, such as rent and rent arrears. This can also help avoid litigation.

However, a notarial deed can be a protection for both parties, as it protects the tenant, for example, from claims of obligations that go beyond those in the contract.

At RealHelp, we encourage the signing of an exit declaration in all rental transactions to protect our clients' interests.
