What should be included in the rental contract?
Obviously, the first thing to include in the tenancy agreement is the details of the parties and the property to be let. The details of the parties should include at least their name, mother's name, address, date and place of birth and address, as the other party will not be able to bring a lawsuit in the event of a dispute if these details are not provided.
In the case of real estate, all the necessary data can be recorded in the contract by obtaining the title deeds
What is of course also essential is the amount of rent and the time and method of payment.
In addition, there may be several other elements to a tenancy agreement:
- the duration of the contract, i.e. whether the contract is for a fixed or indefinite term a provision for subsequent increases in the rent, possibly automatic
- a provision for subsequent increases in the rent, possibly automatic
- provisions on the termination or cancellation of the contract
- the need to regulate what the parties can do if the other party breaches the contract (the property is not fit for purpose or for example, the tenant does not pay the rent on time)
- the possibility of transcribing meters, the time and method of dictating the time of the meter
- the amount of the deposit and how it is to be used
- possible control of the use of the property
- rules of use of the property, e.g. pets, smoking, respecting house rules
- obligations for renovation and repairs during use and when moving out
